Qualified Terminable Interest Property (QTIP)

Property in which the surviving spouse has a qualifying income interest for life (i.e., he or she is entitled to all of the income for life, payable annually or more frequently and with respect to which no person has a power to appoint any part of the property to any other person during the surviving spouse’s lifetime). The marital deduction is allowed with respect to QTIP to the extent the decedent’s executor elects to claim the marital deduction. § 2056(b)(7).
